TERMS OF SERVICE – NATURAL AWAKENING MOVEMENT (NAM)

Welcome to NAM – Natural Awakening Movement. By booking, enrolling, or participating in any of our programs, housing support, community services, or travel guidance, you agree to these Terms of Service. Reading and accepting this document is mandatory for all families and participants.
These terms govern your relationship with Natural Awakening Movement (NAM), Holss Palomino, and any services offered through nam.com.co.
1. Nature of Services
NAM is a family hub and community transition program providing:
• Guidance and support for families relocating temporarily to Palomino
• Assistance in connecting families with local housing options
• Orientation regarding Holss’ alternative education model and academic calendar
• Information about logistics, transportation, activities, and community life
NAM is not a travel agency, tour operator, transportation provider, insurance provider, medical institution, or traditional school.
NAM’s role is limited to advice, orientation, and connection, without assuming any operational responsibility for third-party services.
2. Scope and Limitation of Liability
2.1 Participant Responsibility
Families acknowledge and agree that they participate in all activities in and around Palomino at their own risk, including but not limited to:
• river tubing or tubing excursions
• hikes, waterfalls, nature activities
• surfing or ocean-related activities
• visits to rivers, beaches, or natural sites
• transportation by car, moto, mototaxi, boat, or 4x4
• stays in private homes or rentals
• any independent activity chosen by the family
Parents are fully responsible for their own safety, their children’s supervision, health, and behavior.
2.2 Release of Liability
By accepting these terms, the participant expressly agrees that NAM shall not be liable for:
• accidents, injuries, illnesses, or medical emergencies
• property loss or damage
• failures, delays, or issues caused by housing owners, drivers, guides, or any third-party provider
• weather conditions, infrastructure failures, power or water outages
• flight delays, cancellations, or travel disruptions
• events or circumstances beyond NAM’s control
Participants agree to fully release NAM from any claims, demands, damages, or liabilities arising from their participation or that of their children.
3. Housing and Third-Party Services
NAM connects families with available housing options, but all homes are owned and operated by independent landlords or managers, not by NAM.
NAM does not guarantee:
• housing availability
• specific conditions or amenities
• maintenance, repairs, or management responses
Any housing-related issues must be resolved directly with the property owner or administrator.
4. Insurance Requirement
All participants are required to have international medical insurance or travel insurance covering accidents, medical emergencies, evacuation, and outdoor activities.
NAM is not responsible for any medical expenses or emergency-related costs.
5. Booking, Payments, and Cancellation Policies
5.1 One Month Program
• Payment of 100 percent upfront is required at booking.
• The reservation is only confirmed once payment is received.
Cancellation Policy:
• Up to 30 days before arrival: 50 percent refund
• Less than 30 days before arrival: non-refundable
5.2 Three Month Program
• 50 percent due at booking
• Remaining 50 percent due one week before arrival
• Failure to complete final payment results in cancellation without refund
Cancellation Policy:
• 45 days before start: 50 percent refund of total
• 44 to 15 days before start: 25 percent refund
• Less than 15 days before start: non-refundable
5.3 Six Month Program
• First month payment due upfront at booking
• Remaining balance paid in monthly installments
Cancellation Policy:
• Before start date: 50 percent refund of initial payment
• After program begins:
– current month is non-refundable
– future months refunded at 50 percent
5.4 No Refunds for External Factors
NAM does not issue refunds for:
• personal schedule changes
• illness or medical issues
• canceled flights or transportation disruptions
• weather conditions
• any event beyond NAM’s control
6. Child Participation and Community Rules
Parents or legal guardians are responsible at all times for the safety, supervision, and conduct of their children.
NAM reserves the right to ask families to leave the program if they fail to follow safety rules, community guidelines, or respectful behavior standards. Refunds will not be issued in such cases.
7. Modifications
NAM may update these Terms at any time. Updated versions will be published at nam.com.co and apply to all future reservations.
8. Governing Law
These Terms are governed by the laws of Colombia.
Any disputes shall be resolved in the competent courts of La Guajira.
9. Acceptance
By booking or participating in NAM’s services, the participant acknowledges having read and fully agreed to these Terms of Service.
